Eligibility
You must be at least 13 years old to use Witnsd. By using the Service, you represent that you meet this age requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Your Account
- You are responsible for maintaining the security of your account credentials
- You may not impersonate another person or use a misleading username
- You may not create multiple accounts for abusive purposes
- You are responsible for all activity that occurs under your account
- You may delete your account at any time from Settings within the app
User Content
"User Content" means reactions, significance ratings, sentiments, takes, predictions, lists, profile information, and any other content you submit to Witnsd.
- You retain ownership of your User Content
- By posting User Content, you grant Witnsd a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the Service (e.g., showing your reactions to other users, displaying your takes on event pages)
- This license ends when you delete your content or account, except where your content has been shared by others or incorporated into aggregated, anonymized statistics
- You are solely responsible for your User Content and must not post content that is illegal, harassing, threatening, hateful, or infringes on the rights of others
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Harass, abuse, threaten, or intimidate other users
- Post spam, misleading content, or unauthorized advertising
- Attempt to gain unauthorized access to other accounts or our systems
- Scrape, crawl, or use automated tools to access the Service without permission
- Interfere with or disrupt the Service or its infrastructure
- Circumvent any security measures or access restrictions
We reserve the right to suspend or terminate accounts that violate these Terms.
Intellectual Property
The Witnsd name, logo, design, and all original content, features, and functionality of the Service are owned by Witnsd and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
Event Content
Witnsd curates world events using publicly available news sources and AI processing. Event titles, summaries, and categorizations are editorial in nature.
- We do not guarantee the accuracy, completeness, or timeliness of event information
- Events on Witnsd are not endorsements of any viewpoint or position
- Event images are sourced from third-party providers (Unsplash, news sources) and are subject to their respective licenses
Push Notifications
By enabling push notifications, you consent to receive notifications including new events, social activity, and daily digests. You can customize or disable notifications at any time in Settings > Notification Preferences or through your device settings.
Third-Party Services
The Service integrates with third-party providers (Supabase, PostHog, Sentry, Apple, Google, Expo). Your use of features powered by these providers is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results or information obtained through the Service will be accurate or reliable
- Any defects in the Service will be corrected
Limitation of Liability
To the fullest extent permitted by law, Witnsd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim (if any).
Termination
- You may stop using the Service and delete your account at any time
- We may suspend or terminate your access if you violate these Terms or engage in conduct that we determine is harmful to other users or the Service
- Upon termination, your right to use the Service ceases immediately. Sections 3 (license grant), 9, 10, and 12 survive termination.
Governing Law
These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top and, where appropriate, notify you through the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.
